Court tosses out Guns N' Roses frontman's 2010 lawsuit against Activision, which claimed publisher duped him.
Activision has scored a Guitar Hero legal battle, according to a new report at The San Marino Tribune. A Los Angeles Superior Court judge has dismissed the remains of Guns N' Roses singer Axl Rose's lawsuit against the publisher, which claimed Activision duped him in several ways.
Rose sued Activision in 2010 for its use of the virtual likeness of Saul Hudson (better known as the top-hat-donning axe legend Slash) in Guitar Hero III. Rose further alleged that Activision convinced him to lend "Welcome to the Jungle" to Guitar Hero III on the grounds that the game would not feature Slash's likeness or the guitarist's follow-up group, Velvet Revolver.
Slash was featured heavily in Guitar Hero III. He graced the game's cover and was a playable character in the game. Further, songs from Velvet Revolver ("She Builds Quick Machines," "Slither," and "Messages") were made available to gamers as downloadable content following the game's release.
Rose also claimed Activision promised him a band-specific title called Guitar Hero: Guns N' Roses.
An Activision representative was not immediately available to comment.
The high-profile No Doubt vs. Activision Band Hero suit was settled in October. Terms of the deal were not specified, though the settlement came just days before the case was to be heard by a jury.
I have to side with Axl on this one. Activision has done this numerous times because they know they can either win the lawsuit because of their top tier lawyers or just pay a sum out after the fact because they still make way more from the likenesses and songs than they pay out after.
Congratulations Axl, you greedy prick. I'm glad you lost. Now maybe, for an encore, you can go off and try to make Chinese Democracy 2 and bankrupt yourself in the process. Then we will never have to hear about your dumb ass ever again.

Activision has world class lawyers. I honestly don't care who won this case, I didn't have all the facts anyways.
This is quite possibly the ONLY instance where I wanted Activision to come out on top. Rose is such a child. Needs to get his head out his ass and come back to reality.
Although Axel is a tool and a jerk that pretty much bankrupted Geffen Records all by himself with Chinese Democracy, I was hoping that one more lawsuit would have sided against Activision (besides the IW and No Doubt cases). DIdn't really think anything would have come out of this as it sounded like typical Axel Rose paranoid, self-centered drivel from the beginning, one could have hoped.

I don't give a flying f__k if Activision won. I still hate the buggers. Proudly admitting I haven't bought a single Activision game (Other than Blizzard products) since Activsion started their whole stupid lawsuit crusade against everyone.
Actually the "lawsuit crusade" was launched by everyone else against Activision. Former Infinity Ward employees, No Doubt, and Axel all filed against Activision first, most with just cause which the courts agreed with. Activision just counter sued to save face.
@dlCHIEF58 @feleas lawsuits against Double Fine, EA, a Starcraft 2 player? Activision isn't innocent. They cause trouble as much as they try to prevent it. I lost faith on Activision a long time ago. That lawsuit against a Starcraft 2 player was the straw for me, just glad Blizzard stepped in and pretty much told the Activision CEO to f__k off in the most diplomatic way I've ever seen lol.
@dlCHIEF58 @feleas Oh no, I'm talking about the lawsuit where the Starcraft 2 player made a World of Starcraft custom map and Activision slapped down copyright issues over it with how it was too much like World of Warcraft apparently. Blizzard defended that individual and the case didn't fall through.
Never said they were innocent as I stated that the majority of the cases filed against them were done so with just cause. The Double Fine/EA suit was a stupid cash grab as they gave up the rights to publishing the game then were butthurt when EA stepped up to publish it.
Regarding the Starcraft II incident, are you referring to the 3 hackers that Blizzard sued for selling and distributing tools to circumvent Battle.net? If so, you have your facts all screwed up. Blizzard were the ones who brought suit, not Activision - Kotick had no part in this. It was also dropped for some unknown reason. And this suit was justified as those hackers deserved to get the pants sued off of them, especially when they were trying to profit from it at Blizzard's expense.
And those two examples hardly represents a "lawsuit crusade". But Activision has spent a lot of time in court recently, which does not speak well of how they treat their partners or employees.

Yes they did, it just got ruined by all the other crap filler Activision stuck in there and Eddie's hubris that would not let them put in any Sammy era songs in the game (or Michael Anthony's likeness even for pete's sake).
Guns N Roses had about 3-4 hits that weren't covers. Van Halen had a couple albums that almost all the songs on them were hits (and admittedly some of them were also covers, but at least they didn't suck like GNR). .
So, the lesson to learn here is... DON'T TRUST THE SUITS, duh. Slash certainly seems to have been promised all kinds of awesome stuff, but he never got any of it in writing and was dumb enough to believe whatever the Activision suits were feeding him.

Rose and Slash, a couple of talentless assholes. All anyone in the early nineties listened to was GunsNRoses, possibly the worst band ever. I hated these guys and was so excited they slipped into obscurity after Use you Illusion.

@20years Marty Friedman, Jeff Loomis, Dave Mustaine, Tosin Abasi are just a couple of guitarist that are better then Slash, i don't mind Slash at all but top 2? Nah.
As for Axl he is just a ego freak, simple as that.
Just broaden your horizons. Most of my tastes lie in the 60s 70s and 80s(embarrassingly). Because of my father I also listen to a considerable amount of music from the 30s and 40s. If you only listen to old music there is no way to broaden your tastes. It doesn't matter how brilliant you think the music is. Even if it is Bach. At some point it is just obsessive compulsive ruminations.
As an example, I have listened to Pink Floyd Animals, so many times, I have a hard time listening to it anymore. The enjoyment has diminished over time, like watching a movie or playing a video game too many times. But we're not all the same. One man's ceiling is another man's floor. So I guess we're different because you wouldn't get a little tired of playing your favorite video games every day for 30 years without adding any new ones.

There's something to discover in music you have listened to 1000 times. Don't talk crap about having to "get with the times". Nonsense.
@BoldukAre you telling me you wouldn't get a little tired of playing your favorite video games every day for 30 years? I have no qualms with loving older music but come on, you can't just live in the past, it gets boring, because nothing new ever happens. Plus, you can't be a real connoisseur of music unless you attempt to broaden your horizon with more, different and newer ever evolving music.

Rock bands of the 60s to 80s era are far far far better the the trash we are getting these days with Modern rock. No offense to them, bacause I have to admit I love a couple of them myself, but back in the good old days, there was more than just one hit song on an album that warranted its purchase. Led Zep, Queen, AC/DC, ect 's albums are masterpieces and best ofs by themselves.
